invalidate legislation duly enacted by the elected representatives of the people? What are
some examples of “good” and “bad” judicial review in civil liberties cases and, how can
we distinguish the “good” from the “bad” ?
2. Must civil rights and liberties rest, in the end, on some form of faith? Is there a moral
foundation for civil rights and liberties? Or is belief in moral truth a threat to civil rights
